Can they ticket for excessive whining?

"I'm being charged with a criminal complaint. I honestly am speechless," stated Karyl Hylle.

Wally it seems, has gone beyond wet sloppy kisses and over exuberant head nudges. He has gotten his owner a misdemeanor ticket and so far, at least one court visit. Wally the steer..... I know, I was even shocked to read this, moos and evidently moos loudly.

Karyl Hylle has received a misdemeanor ticket that specifically cites her for "ongoing nuisance cow mooing." Wally has led Hylle's Washington County MN neighbor to file 21 complaints because of what they feel is excessive mooing. Hylle admits that Wally is like normal cows, he moos but they are few and far between.

It seems as though she knows her beef because not only did Wally not moo for the officials when they visited her and cited her but when the local media went for an interview....... Wally again was speechless, for more than an hour that day.

Life for Wally the steer isn't spent crammed into a suburban neighborhood, he enjoys a life of leisure on Hylle's 33 acre farm that is a zoned farm. She could have 50 head of cattle on her property. Think of that, one steer equals over 20 complaints, imagine if Hylle had 50 of them. Her neighbor might have to listen to more than a couple moos an hour, farm equipment running in the wee hours of the morning and trucks making deliveries.

So far, Hylle has had to make one court appearance and she faces a $1,000 fine and or 90 days in jail for Wally's alleged vocal disturbances. The Hugo city attorney says that he has never seen a case like this in his fifteen years of prosecuting. He said the next step is to see if it is even an enforcable citation, something he doubts it is.

In the meantime, Hylle will still be facing the responsibility of the citation and the court system is spending money on her "case." I may be jumping the gun here but it seems to me, Wally didn't make a sound when officers visited and ticketed Hylle........ the only complaints come from a neighbor, a person who is living next to a zoned farm. Unless we are living in a country that is more interested in personal whining cases tying up the courts, Hylle's case should have been tossed a long time ago.
