The long road back

On July 30 2007, Jefferson Circuit Court Judge Barry Willett ruled that no destructive testing may be done to the broken cable from the ride involved in Kaitlyn Lasitter's accident until all parties agree on the types of tests and who will perform them. Kaitlyn's parents filed suit against the theme park and had sought an injunction preventing the park from destroying either the Superman Tower of Power or the cable involved.

The Department of Agriculture, which is handling the investigation, has the cable locked away at the theme park. They had awarded a contract to an independent laboratory in Cincinnati to test the cable stated Bill Clary, a spokesman for the department. Attorneys for the Lasitter family, Kentucky Kingdom and the department, now have until Aug 16 to agree on which tests will be performed and which company will perform them. If the cost of the testing exceeds the original state contract, then all the parties will also have to agree on who will pay for them.
