I thought cheating would be E-Z

Cheating on your partner it seems, has been happening since there were partners to cheat on. The newest technologies have made it so much easier than sneaking mid-day into an out of town motel and hoping no one spotted you. There is the Internet, acceptance of credit cards almost everywhere, text messages and more, to make it easy to "hook up."

Now it also seems, some of those cheaters are facing the reality that what seemed to make cheating so easy, also has made it easy to get caught. While mere decades ago, it was one persons word against another unless they had been caught on film or in the act. Today, the technologies that make it easy, make it much easier to have proof in hand of the cheating.



"E-ZPass is an E-ZPass to go directly to divorce court, because it's an easy way to show that you took the off-ramp to adultery," stated Jacalyn Barnett, a New York divorce lawyer.

Barnett as well as other divorce attornies have stated that they have been able to use E-ZPass records to prove that the cheating partner was not where they claimed to have been. Of the twelve states in the Northeast and Midwest that are part of that system, seven will provide toll information in response to a court order in criminal and civil cases, including divorce. Four of the states will only provide them in a criminal case but many times they can be provided by the spouse if they are also on the credit card used.



"When you're marketed for a new convenience, you may not realize there are these types of costs," stated Nicole Ozer of the American Civil Liberties Union of Nothern California.

Some worry that using these records for other purposes may be a violation of a driver's privacy. Some attornies though have said that bringing up the toll records to prove where they had been can destroy the credibility of the one cheating. Others such as Bob Barr, Libertarian and privacy rights advocate simply state, if people want to protect their privacy, they shouldn't use an electronic toll system.

Leroy Greer it seems, also took advantage of the electronic age and now thinks he is deserving of $1 million from 1-800-flowers. He has filed suit in Houston TX this past week claiming that the company should pay for the mental anguish and the increased amount he expects he will have to pay in his divorce, now that his wife has new evidence against him.

The Greer's have had their divorce pending in Fort Bend County since 2005 and it was described as amicable at the start. Greer's wife Bernice, had moved out of the Missouri City home and during that time, Leroy chose to send flowers and a stuffed animal to his girlfriend along with a note. He states that he chose them because they stated they would not send or share any information of the transaction. Greer reconciled with his wife and Bernice moved back into the home. It was during that time that 1-800-flowers sent a discount coupon and thank you card to the home.

Greer's wife was confused by the thank you card and called the company, which faxed a copy of the receipt. The receipt had the name of the woman who received the $100 in gifts, marked "Occasion: Love & Romance, as well as the note that read: "Just want to say that I love you and you mean the world to me! Leroy." Leroy's lawsuit records include the reciept along with his wife's added comment, "Be a man! If you got caught red handed then don't still lie. You're tmobile has her number so why still lie."

Needless to state, Greer's wife moved out again and is now seeking an additional $300,000 as well as $4,000 to $5,000 a month in child support for the boy they had together.Greer, a luxury car sales manager, now claims he is facing a hellish divorce and Bernice's attorney has said nothing has been done with the divorce since February 2006.

The court records show that they had filed and withdrew divorce actions twice previously. Leroy has to now prove that not only did 1-800-flowers break a contract he believed was there but he also has to prove that the divorce, if it is ever settled, has cost him more now that his wife has the fax. I am just guessing but I think if he had come clean with Bernice about the girlfriend during the reconciliation, he may not be in the "financial hot-water" he is in now. The other choice would be, just using untracable cash.

The electronic age seems to have made so many things possible and easy.... as well as making it so much easier to have solid proof of cheating. The best advice seems to be, if you want to still avoid detection..... use the old method of cash and keep your eye out for cameras and forget trying to sue when you get caught electronically.
